Terms and Conditions

A. Use of Site by Minors
If you are under 18, you may register and use the Website and App only with the involvement of a parent or guardian. Ride Culture does not accept the online registration of minors; please do not attempt to register on the Website or App if you are under the age of 18. Registration of a minor is permitted for Ride Culture classes only and must be completed in person at our studio with a parent or guardian. Minors who are at least 13 years of age, meet the minimum height requirement of 4’11,” who have submitted a Minor Waiver and Release Form signed by a parent or guardian, may sign up for Ride Culture classes online.
B. Reservations/Charges/Classes and Gift Cards
In order to make a reservation, you must first purchase a single class or a package of classes. Class purchases can be made either in-studio or online by using your email and creating a password or, if you have already registered, by logging in to purchase and make your reservation.

In addition to classes and packages of classes, you can also purchase a gift card. Ride Culture’s gift cards never expire and can be applied toward the purchase of classes or merchandise. Once a class is purchased using a gift card, it will expire, just like any other classes purchased.  Gift cards must be used to purchase classes or merchandise from Ride Culture, can be transferred from the purchaser to any other person, but cannot be redeemed for cash.

Gift cards and classes are not the same thing. Unlike gift cards, classes are for our rides/classes only. You cannot gift classes to another person. When you purchase a class, you are only entitled to use that class to reserve a bike in a particular studio for a specific time. You cannot redeem your class for cash, and you cannot transfer your class to another rider or community member.

Classes expire 12 months from the date of purchase (unless otherwise stated).  The expiration date is posted in the description of the class or package of classes on the Website and the App and listed on your receipt. If, however, you are unable to book a ride/class in time, call, visit, or email the studio, and we may be able to assist you.

Future class prices are subject to change, but Ride Culture will honor your class or package of classes until the expiration date, regardless of whether there is a price increase in the interim. We accept MasterCard, Visa, Discover, and American Express. Cash payments are not accepted. You can reserve classes online up to 1 week in advance (Monday at noon through the following Monday), but no later than 30 minutes prior to class time.

Your credit/debit card will be charged when you purchase your class or package of classes, not when you reserve your bike. Ride Culture will not process charges that use an incorrect, expired, or over-the-limit credit card. We will try to contact you if this occurs. If you fail to pay any fees or charges when due, services or privileges may be suspended or terminated. You shall be responsible and liable for any fees, including attorneys’ fees and collection costs, that Ride Culture may incur in its efforts to collect any unpaid balances from you.
C. Memberships

Ride Culture offers different membership options, some that renew and some that do not auto-renew. These memberships allow you to take either an unlimited or limited number of classes during the membership period.

Unlimited Membership

Ride Culture offers a 30-day unlimited membership option that does not auto-renew. This membership allows you to take an unlimited number of classes during the membership period.

Limited Membership

Ride Culture offers a 30-day limited membership that automatically renews once the current period has expired. This membership allows you to take 8 classes during the 30-day period. If you would like to take additional classes, you must purchase additional credits or class packs.

In order to cancel the auto-renewing limited membership option, you must notify the studio in writing of your cancellation with a minimum of 30 days’ notice. You can submit your cancellation via email to info@rideculture.com. Once your cancellation has been accepted, you will be required to sign a cancellation form to confirm your choice.

There are no exceptions to this cancellation policy. By purchasing these memberships, you agree to the
terms and conditions set forth for each specific membership option.
D. Cancellation Policy for Reservations
In order to cancel a reservation in a Ride Culture class and return it to your account, you must unreserve no less than 8 hours in advance of the start of the reserved class time. There are different cancellation policies based on the type of purchase you have in your account (packages, single classes, or memberships).

Packages and Single Classes

Once your reservation is cancelled, the class will be returned to your account to be used at a future date; the class is not refunded and remains as an active credit on your account. If you have not cancelled at least 8 hours in advance of the start of the reserved class, it will result in a loss of class credit. If you fail to cancel your reservation on time, and do not show up to your reserved class, this will also result in a loss of class credit.

Memberships

If you have not cancelled at least 8 hours in advance of the start of the reserved class, it will result in a $25.00 charge to your account. If you fail to cancel your reservation on time, and do not show up to your reserved class, you will also be charged a $25.00 “No Show-No Cancel” fee.
You can cancel your reservation in the following ways:
Please note, in fairness to all our customer, BIKES AND SPOTS WILL BE RELEASED 4 MINUTES BEFORE CLASS BEGINS. In the event that you do not unreserve your bike at least 8 hours in advance of the reserved class time, or if you do not claim your bike at least 4 minutes before class begins, Ride Culture shall have the right, without any credit or refund to you, to allow others to reserve or use your bike for a fee.
FOR RIDERS AND COMMUNITY MEMBERS RUNNING LATE: We ask that you call the studio to let us know you are on the way. If you call the front desk at least 4 minutes before class begins, we will hold a reservation until class begins, though we cannot guarantee you will be given the bike you signed up for in the particular class. At this time, we cannot accommodate late riders. Once the studio door closes and class begins, we will not be able to let riders in.
FOR RIDERS AND COMMUNITY MEMBERS LEAVING EARLY: If you are planning on leaving early, we kindly request that you tell the instructor ahead of time.
E. Waiver and Release
By signing up for and/or attending Ride Culture classes, events, activities, and other programs and using the premises, facilities, and equipment (individually and/collectively, the “Classes and Facilities”) of Ride Culture and its subsidiaries, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and use of the Facilities. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You also acknowledge that the specific risks vary from one activity to another but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, rhabdomyolysis, and concussions; and (3) catastrophic injuries including paralysis and death.
You have read and thoroughly understand the Ride Culture Bike Safety Instructions that are posted on Ride Culture’s Website, a hard copy of which is also available in studio, upon request. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by staff.
If in the subjective opinion of the Ride Culture staff, you would be at physical risk using Ride Culture’s Classes and Facilities, you understand and agree that you may be denied access to the Classes and Facilities until you furnish Ride Culture with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing Ride Culture’s concerns and stating that Ride Culture’s concerns are unfounded.
In consideration of being allowed to participate in and access the Classes and Facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes and Facilities, whether sustained while using exercise equipment or not, (2) release, indemnify, and hold harmless Ride Culture LLC, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all other, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Classes or use of the Facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of Ride Culture’s Classes and Facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in Ride Culture’s Classes and Facilities and should not be participating in any Classes.
F. Intellectual Property Rights
The trademarks and trade dress of Ride Culture are proprietary to Ride Culture and may not be used by you for any reasons other than as expressly permitted by these terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, Ride Culture. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.
Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without prior written permission of Ride Culture, is strictly prohibited.
You acknowledge that Ride Culture and/or third-party content providers remain the owners of all Website and App materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms. Ride Culture may discontinue or remove the Website or App, or any portion thereof, or discontinue your right to use the Website or App, or any portion thereof, at any time.
G. Acceptance of Terms
The trademarks and trade dress By using the Website or App, purchasing a Ride Culture class, registering for a Ride Culture class, booking a bike, purchasing merchandise, and/or using or attending a Ride Culture class, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website or App, purchasing a Ride Culture class, registering for a Ride Culture class, booking a bike, purchasing merchandise, and/or using or attending a Ride Culture class.of Ride Culture are proprietary to Ride Culture and may not be used by you for any reasons other than as expressly permitted by these terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, Ride Culture. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.
Occasional changes may be made to this document to reflect changes in Ride Culture’s policies. The terms may be revised at any time by updating this posting. By using the Website or App, by buying Ride culture classes, registering for classes, booking bikes, buying merchandise, and/or using and attending the Ride Culture studio, you agree to be bound by any such revisions. Riders and community members are encouraged to check this document periodically to stay informed of current guidelines.
H. Grant of Publicity Rights and Publicity Rights Release
For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, you for yourself, your marital community, heirs, executors, listed minors, and assigns do hereby forever grant Ride Culture the perpetual, irrevocable, royalty-free, non-exclusive, worldwide, sublicensable right and license to: (a) use, edit, reproduce, modify, portray, publish, copy, distribute, publicly perform and display without restriction all or portions of your or your child's identity and your or your child's experience in and with the Classes and Facilities including, without limitation, your or your child's name, fictional names (if any), voice, signature, photograph, social media posts, words, image, personality or other likeness of you or your child, and any audio and video recordings of you or your child or remarks and statements made by you or your child (“Images and Remarks”); (b) use, copy, distribute, perform, display and create derivative works of your or your child's Images and Remarks or using or incorporating your or your child's Images and Remarks; and (c) create other materials or copyright protected works using or incorporating your or your child’s Images and Remarks (“Promotional Materials”), in any form or manner, including any electronic or non-electronic medium now known or later devised, all in connection with Ride Culture’s Classes and Facilities for advertising, distribution, marketing, promotion, publicity, or any other lawful purpose.

You irrevocably waive any of your or your child's right to own, inspect, approve or receive any payment or attribution with respect to any works or Promotional Materials of Ride Culture using your or your child’s Images and Remarks, any accompanying written copy or printed matter, or the use to which it is applied. You understand and agree that the Images and Remarks, and Promotional Materials containing or based on your or your child's Images and Remarks may be used without any restriction as to changes or alterations, and may be modified, used in derivative works, distorted, included in composites or otherwise used in unexpected contexts, manners, or forms, or may not be used at all, and you grant Ride Culture all necessary rights to do the foregoing.

To the extent moral rights in your or your child’s Images and Remarks or any Promotional Materials may not lawfully be waived, you hereby agree not to bring any actions or claims against Ride Culture therefore.

You, on behalf of yourself, your marital community, heirs, executors, listed minors, and assigns, hereby fully and forever release, discharge, and agree to indemnify, defend and hold harmless Ride Culture LLC, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages (including, without limitation any direct, indirect, incidental, consequential, special or punitive damages), losses, expenses and liabilities (whether under contract, warranty or tort, including negligence (whether active, passive, or imputed) relating to any claim that you or your child may have, now or in the future, based on: (a) any usage or adaptation of your or your child’s Images and Remarks or portions thereof, or works or materials derived therefrom including, but not limited to, claims for libel, defamation, invasion of privacy or rights of publicity, infringement or violation of moral rights or any other right arising out of, or relating to, any utilization of your or your child’s Images and Remarks, including by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, or based upon any failure or omission to make use thereof (collectively, “Harm”) that may be suffered by you, your child, or any third party as a result of, or in connection with, your or your child’s participation in the Classes and use of the Facilities. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS EACH OF THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, COSTS, LOSSES, DAMAGES AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) INCURRED BY ANY RELEASED PARTY ARISING OUT OF OR IN CONNECTION WITH ANY HARM OR RELEASED CLAIMS.
